Nevada Assembly Bill 279 proposes a permanent ban on the sale of cigarettes to individuals born after December 31, 2004, except at certain casinos. The bill, sponsored by Assemblymember David Orentlicher, aims to phase out combustible tobacco products to reduce health risks associated with smoking. While the sale of cigars, chewing tobacco, and nicotine-based vape products would still be allowed for individuals over the age of 21, the focus is on eliminating the most harmful option – cigarettes.
The bill includes a loophole that allows cigarette sales at casinos with nonrestricted licenses. This exception, inspired by a similar law in Beverly Hills, is intended to cater to tourists. While no other states have implemented a generational ban on cigarette sales, some communities, like Brookline, Massachusetts, have done so successfully.
Opposition to the bill comes from various groups, including smoke shop owners concerned about revenue loss, and tobacco-free advocates who believe all tobacco products should be treated equally. Despite the pushback, public health experts believe that limiting access to cigarettes will ultimately reduce smoking rates, especially among the targeted younger demographic.
The bill’s proponents argue that restricting cigarette sales will lead to fewer people smoking, citing data that shows a decline in cigarette use among young people. While concerns about driving individuals to casinos to purchase cigarettes have been raised, the overall goal of improving public health through reducing tobacco use remains a priority.
