UTEP refuses to disclose its MW membership agreement citing competitive disadvantage

UTEP athletics has refused to release its membership agreement with the Mountain West conference to Nevada Sports Net, citing concerns about a competitive disadvantage. The issue escalated to the Texas attorney general’s office, which ruled in favor of UTEP withholding the contract due to potential harm to its interests by providing an advantage to competitors. The university argued that releasing the information could allow competitors to undercut or duplicate its strategies and undermine its position in the marketplace.

The attorney general’s office agreed with UTEP’s argument that the release of the information could give an advantage to competitors or bidders, allowing the university to legally withhold the contract from public disclosure. This decision has prevented Nevada Sports Net and another unidentified source from obtaining insight into the upcoming additions of five schools to the Mountain West conference in 2026.

With five schools leaving to join the Pac-12 in 2026, including San Diego State, Boise State, Colorado State, Fresno State, and Utah State, UTEP, along with Hawaii, Grand Canyon, UC Davis, and Northern Illinois, will become full or affiliate members of the Mountain West. The conference will also retain UNLV, Air Force, Nevada, San Jose State, New Mexico, and Wyoming. This decision highlights the complex and competitive nature of college athletics and the importance of strategic planning and visibility for universities in the marketplace.
