Washington state wins appeal against church in abortion coverage case | Global News


In a recent decision by the 9th U.S. Circuit Court of Appeals, the Cedar Park Assembly of God of Kirkland in Washington failed in its attempt to challenge the state’s Reproductive Parity Act. The law requires insurers offering maternity coverage to also cover abortions, which the church argued violated its religious rights under the First Amendment. However, the court ruled that the church lacked standing in the case as some insurers still offer plans that exclude abortion services.

The church’s appeal drew support from various conservative entities, including 18 U.S. states. Despite the church’s claims of potential harm from insurers raising premiums or employees using abortion services, the court found these arguments to be speculative.

Circuit Judge Consuelo Callahan dissented, pointing out the church’s dilemma in choosing a plan that covers abortions or violating its free exercise rights. The church’s lawyer expressed shock at the decision and is considering further legal options to continue the case.

Despite the ruling, the Washington Attorney General’s office appreciated the court’s consideration. The case, which began in 2019 when Kaiser Permanente required abortion coverage in its group plan, was ultimately dismissed for lack of standing by the court. The decision did not address the constitutional question, leaving the church’s free exercise rights unresolved.
