Nevada Governor Joe Lombardo signed the state’s Election Worker Protection Law in 2023, aiming to protect election workers from harassment and interference. A group of former election workers and poll watchers challenged the law, claiming it was vague and violated their rights under the First and 14th Amendments. The case was dismissed twice at the trial court level for lack of standing before being appealed to the 9th U.S. Circuit Court of Appeals.
The court will hear oral arguments on March 7 to determine if the plaintiffs have standing to sue. The defendants argued that the plaintiffs could not show how they would be harmed by the law and lacked specific examples of protected speech prohibited by the law. If the appeals court rules in favor of the plaintiffs, the case will return to trial court to determine the constitutionality of the Election Worker Protection Law. The outcome of this case could have significant implications for election laws across the country.
