Since Matt Gaetz resigned from the House and withdrew his name as a nominee for attorney general, questions have arisen about his political future. Although he resigned from the current Congress, he was re-elected to represent his Florida district in the upcoming session starting in January. However, he cannot return to the current Congress due to House rules on resignations.

Regarding the 119th Congress starting in January, Gaetz stated in his resignation letter that he does not intend to take the oath of office for that session. A special election may need to be organized to fill his seat, but it has not happened yet. The possibility remains that Gaetz could reverse his decision about taking the oath, although there is limited precedent for such actions.

If Gaetz does return to Congress, the Ethics Committee investigation into him could continue and release its report. However, if he does not return, Ethics Committee Chair Michael Guest has indicated that the committee’s involvement in the matter should end. Despite this, some Democrats are still pushing for a vote to compel the committee to release its report. Speaker Mike Johnson has stated that this issue will be addressed after Thanksgiving.

Overall, Gaetz’s political fate remains uncertain as he navigates the aftermath of his resignation and potential return to the House in the upcoming session.
