Trump and the Republican National Committee Fail in Attempt to Disqualify Nevada Ballots Without Postmarks Arriving After Election Day

Nevada Supreme Court Upholds Policy of Counting Mail-in Ballots Without Postmarks

In Nevada, the Supreme Court has upheld the state’s policy of counting mail-in ballots without postmarks received up to three days after Election Day. This decision comes after a lawsuit filed by the Trump campaign and Republicans challenging the policy, claiming it would harm Republicans who vote by mail at lower rates than Democrats. The court rejected the Republicans’ attempt to block the policy for this election, stating it would go against public policy to discount properly cast votes due to post office errors in postmarking.

During oral arguments, questions were raised about treating non-postmarked ballots differently than those with smudged postmarks. Pro-voting organizations argued that non-postmarked ballots are a small subset and are typically due to post office errors, not voter fraud.

The court’s decision marks a defeat for the Trump campaign and the Republican National Committee in their attempts to challenge mail-in voting ahead of the November election. This loss in Nevada follows previous defeats in federal lawsuits and attempts to remove voters from the state’s voter rolls. Despite the ongoing legal battles, it is unlikely there will be any changes to the mail-in ballot policies for the upcoming election.

Overall, the Nevada Supreme Court’s decision ensures that properly cast mail-in ballots without postmarks will be counted, protecting the integrity of the voting process.
