Nevada Attorney General Seeks to Revive Fake Electors Case by Appealing to State High Court


Nevada’s top prosecutor is seeking to uphold the indictments of six Republicans accused of submitting a fake certificate to Congress declaring Trump the winner of the 2020 election. The indictments were part of a larger scheme in several battleground states to keep Trump in the White House after losing to Biden. The fate of the case, known as the fake electors case, is uncertain as a judge ruled Las Vegas was the wrong venue for the trial.

Attorney General Aaron Ford filed an appeal after the judge’s ruling, expressing confidence in bringing the defendants to justice. The six individuals, including GOP chairman Michael McDonald, were indicted on charges related to offering a false instrument for filing and uttering a forged instrument. The defense attorneys believe the judge’s decision to dismiss the case will be upheld.

The defense argued that the case should have been brought in a northern Nevada city where the alleged crimes took place, rather than in Las Vegas. Ford’s office contended that the crimes occurred across multiple counties, justifying the venue. The Nevada Supreme Court has yet to schedule oral arguments in the case.

Trump lost to Biden in Nevada by over 30,000 votes, with investigations finding no credible evidence of widespread voter fraud in the state. The prosecution of the six individuals is part of efforts to hold them accountable for their actions in the aftermath of the 2020 election.
